Chakri Dogiparthi Posted February 26, 2019 Report Share Posted February 26, 2019 Hi, My wife applied for a COS from H4 to F1 around 04/2018. However, we had to travel to India during 12/2018. Today, we came to know that I539 has been denied. We are assuming that traveling while COS is pending caused this. Is there any way an MTR can help in this case. Thanks in advance for any ideas. JoeF Posted February 26, 2019 Report Share Posted February 26, 2019 Any COS is canceled if the person travels abroad, because by definition there is no status to change when a person is abroad. An MTR is not possible on this, because she was abroad, and the denial was a direct consequence of that. She either would have to file a COS again or go abroad and get an F1 visa and use that to enter. Link to comment
Provence Posted February 27, 2019 Report Share Posted February 27, 2019 MTR is when either USCIS made a mistake or you forgot to include something relevant. Exiting the US invalidated the COS; MTR in this case would be is a slam dunk no-no. Link to comment

He leaves the US and applies for an F1 in India, as an Indian national. And assuming he applies to a non-profit, public university. Link to comment
