On January 18, 2019 the USCIS sent a NOIR on my approved H1b visa petition. My employer told me that they are drafting a response for the NOIR. My question is can I find a new employer even if there is NOIR on my visa petition with my current employer or should I wait for the decision on my case before finding a new employer. Usually how long does it take for the USCIS to make a decision? Link to comment
NotAnAttorney Posted February 13, 2019 Report Share Posted February 13, 2019 ask your employer to share the NOIR. If its related to fraud/misrepresentation then you are in trouble and need to consult an attorney to formulate a strategy. Link to comment
xTDx Posted February 13, 2019 Report Share Posted February 13, 2019 NOIR is just a notice of intention to revoke. It is not revoked yet. If you have worked on h1b for at least a few days and you have a valid i94, a new employer in theory can apply for change of employer H1b petition with i94 extension. Nobody knows about the timelines, depends on case to case. Link to comment
