bdb0809 Posted February 11, 2019 Report Share Posted February 11, 2019 I moved to a new Employer on an H1 transfer receipt. Worked for them for 4 months and the transfer got rejected. Fortunately my Visa with the previous employer was still active at that time so I moved back to him. As soon as I joined the old employer we applied for an extension-amendment. I got an RFE on that application. USCIS is asking to explain the employer-employee relationship for the past 1 year; prior to applying for this extension. I am ready to produce the pay-stubs from the other employer I joined for four months. There are two more questions in regards to "work at client site", and "speciality occupation". How difficult will it be to reply to this RFE. I assume this is a common case as people tend to move to a better opportunity. I am looking in to hiring an attorney for the same. USCIS is expecting a reply by/before April 1st. Looking forward to your response. Link to comment
Provence Posted February 12, 2019 Report Share Posted February 12, 2019 Your employer's attorney should be familiar with the process. Attorneys deal with legal stuff like filing petitions and responding to RFEs. Should be a similar set of attorneys who offered advise on LCA issues 3 years back. Link to comment
