H1B denial was re-opened for reconsideration after MTR, now got RFE on the denied petetion

Hi,

My H1-B extension was denied in March 2018. As my I-94 was already expired, I left USA within a week of denial. My employer applied for MTR in the same month.

I came back to USA on H4 visa and made a COS to H1 again for the same client, but my primary vendor sponsored my H1B this time. I asked my old employer to withdraw MTR as I am not interested to join them anymore, but they did not withdraw MTR.

Now, my old denied H1B is re-opened for reconsideration. They sent an RFE on this case last week. My old employer is not responding to me.

 

1. Will this RFE has any impact on the current approved petition?

2. Will my old employer be able to withdraw my old extension case with RFE?
