nisargmca Posted January 28, 2019 Report Share Posted January 28, 2019 Dear Members , My I-94 is going to expire on Feb 28 2019 .My Employer has filed H1B Amendment + Extension in Julu 2018 and its still pending. Can I file I -485 (Family Based ) after my I -94 Exprire and falling into grace period of 240 days ? If H1B extension will be denied then what will be impact of I -485 ? Our Priority date for F4 India is 3rd Jan 2005 and Current Visa bulletin is showing date of 1st Feb 2005 . Can I file I-485 now ? Thanks in Advance Nisarg Link to comment
pontevecchio Posted January 28, 2019 Report Share Posted January 28, 2019 F4 for India is June,22.2004 in the February Bulletin. Hence file your AOS. Once on file you can stay till the GC arrives. Link to comment
