Change of Status to F2 dependent on 6th year of H1B and later extension with approved I140

Hello Sir,

I'm currently in H1B Visa and my 6 yr visa MAX Out date is end of July 2019. My husband is in F1-OPT Visa.

Can i apply for change of status from H1B --> F2 dependent visa on May 2019?
If I apply petition for status change on May 2019, remaining 2 months of my H1B visa will be valid in the later time to apply for H1B extension with approved I1140?(I haven't started my I1140 yet. Planning to start after a break at end of this year).

Please advise whether my change of status would work ? and my remaining H1B visa time can be used for further extension in later point of time?

Yes.

You do not even need  to keep H1 time for you to get a 3 year extension if the I-140 is approved.

You can certainly apply and H1 extensions are possible even if you had no H1 time left.

Thank you for the reply. How many months is the current processing time for H1B to F2 COS now?

I'm also in the same situation. Is it possible for anyone to tell how many months it would take the COS to get approved now?
