I am planning to go to India for my H1B stamping. I have completed my Masters in USA and I am a full time employee. Currently my salary is USD50000 which is less than the LCA amount USD60000. xTDx Posted January 24, 2019 Report Share Posted January 24, 2019 You have to get paid as per LCA from day one of your H1b status. If you are on H1b, your employer violating the law by not paying you the promised salary. Ask them to correct it and back pay you from day 1 of h1b status. If you are on OPT, then this may be okay. Tjgarla Posted January 24, 2019 Report Share Posted January 24, 2019 You need to get the LCA amount from the H1B effective date. I you have 2 months of leaves then that is ok. If you were on OPT then it is ok. But once your H1B is effective you should get 60K , Quote Link to comment

My salary is USD50000 and LCA filled by my employer with H1B petition has mentioned the same amount. My question is that in few other websites I have read that the minimum salary for H1B should be USD60000. Please see below my Visa Experience VO: Please hand me your password ! Aj555: Handed the password. VO: What is your highest degree of qualification ? Aj555: I have Masters degree from University XXXXXXX . VO: What is your Salary ? Aj555: 50000 USD per year VO: Please explain your work duties ? Aj555: I started to explain and VO stopped me in about 20 seconds stating that she was satisfied with the answer. VO: Do you work in house or client location ? Aj555: In house. VO: Congratulations !!! your visa approved. She handed me a white book which contains the information about rights which we have on H1B visa. Quote Link to comment
