K2M Posted January 21, 2019 Report Share Posted January 21, 2019 My company has did I-140 EB-1 Multinational manager category. I am requesting them to file I -485 concurrently. But they are suggesting to wait for I-140 approval due to recent high scrutiny. I am not able to convince my employer’s immigration attorney/law firm. I understand the I-485 will not be approved if I-140 is not approved and we lose money. Below are my queries 1. What are the other risks in filing I-140 and I-485 concurrently and later I-140 denied. Do we know, if this will impact future I-485 processing or any other immigration/non-immigrant visa processing. 2. Can I file the I-485 via a different immigration law firm. JoeF Posted January 22, 2019 Report Share Posted January 22, 2019 You don't even need to have another lawyer. The I-485 is your application, you can file it without any lawyer. Of course, unless the I-140 has been approved for 180 days the employer can always revoke it. The I-140 IS the employer's petition. Link to comment
