No time can be spent on management or any type of work on H1B. Can my spouse work on H1B for same business if her position for the firm is eligible for H1B? Link to comment

JoeF Posted January 16, 2019 Report Share Posted January 16, 2019 This would invite scrutiny. The assumption would be that the company hired her because you are a partner. Whoever receives and evaluates the job application would know that she's the spouse of a partner, which likely would result in preferential treatment. The only way I could see this work would be if the while recruitment for the job is handled by an outside firm. So, in short, your spouse should find work at another company. Link to comment
