Vimal348 Posted January 11, 2019 Report Share Posted January 11, 2019 Hello, I was/is working in an IT company. My 6 years ((Actually 5 years and 10 months) of H1 B completed on last April 2017 . Since I had 2 more months, I've applied for extension and it got rejected after 210 days (November 2017). That time I went back to India and came back with H4 VISA after 2 month (January 2018). So right now I am continuing with H4 EAD and working. In this case am I eligible for applying new H1 B VISA ? Link to comment

Hema Reddy Posted January 11, 2019 Report Share Posted January 11, 2019 No. You have to be out of USA for at least 365 days before applying a new H1-B visa. If you go out of USA before March 31st, then your employer can apply for a new H1B in April 2020. Link to comment
