Nsb25 Posted January 11, 2019 Report Share Posted January 11, 2019 Hi, I am on a H1B visa which is up for extension in Aug’2019. I am currently working in the US. My husband who is in India applied for F1 twice and got rejected in Early December and 1st week of january respectively. We are now planning to apply for an H4 visa and is in progress to finalize a date. Couple of questions: a) Can he take a H4 visa interview date in first week of February (~1 month after F1 rejection)? b) Will having only 6 months left on my current H1B is an issue for visa approval? thanks for your help! xTDx Posted January 11, 2019 Report Share Posted January 11, 2019 (edited) a) Whenever the dates are available. b) It is "usually" not an issue where primary applicant is on H1b like statuses. Your husbands desperate attempts to come as a F1 student may raise a concern on H4 but if the primary purpose is to be with you , he should be okay(though there is a high possibility of 221g/admin processing). Abhinav Gupta Posted January 23, 2019 Report Share Posted January 23, 2019 We are in the same boat. My wife's F1 was denied twice 3rd week Nov 2018 and 1st week Dec 2018.
