SarunH1 Posted January 8, 2019 Report Share Posted January 8, 2019 Hi, I recently had an H1B extension rejection with my current employer A and was subjected to return back to India. Back in India, Another employer B initiated an H1B transfer as a consular process and was approved. In Parallel, my current employer A got my extension again approved through consular processing from India. I got my visa stamped from Employer A and got back into the US. My I797 Document with employer B did not have I94. Now i need to switch to employer B. So in this case since there is no I94 on My I797 from employer B do i need to leave the country and get the stamping done through the Employer B ? or Do i need to initiate a new H1B Transfer petition with Employer B ? Looking for expert opinions here and above options were given by my employer B Link to comment
