Will I come under H1B CAP Exempt in 2019? Please clarify. Thank you. I am currently in India and looking to file for H1B transfer. USA actual working dates: L1B - June 2010 till Dec 2011 18 Months - Visa Expired H1B (1) - Jan 2012 till August 2013 20 Months - Visa Expired H1B (2) - Jan 2015 till June 2015 6 Months - Visa Expired Total = 44 Months (L1B + H1B Stay and Work in USA) Link to comment

rksingh Posted January 8, 2019 Report Share Posted January 8, 2019 Yes you are cap-exempt....the limit is 6years combined L1 + H1. You can use the remainder of 60 minus 44 months to continue H1 employment. Link to comment
