H1bAspirant_RFE Posted January 7, 2019 Report Share Posted January 7, 2019 Hi, Applied for H1B 2019 ,luckily it picked up . Attached client letter with application. History: I am in US on L2 visa. Working on L2 EAD. My employer has applied for H1B this year, got picked up. My contract was till Nov 2018 with client. My EAD expired on October 11th. So I stopped working as I did not filed for L2 extension meanwhile and did not get any response on H1B. After 9 months of wait I got RFE. For client letter( though submitted it before) and Vendor contract. When I approached my client for client letter as there are like 600 hours left on my contract. Client denied my request for letter but assured he will give offer once I get my work permit. So wondering how to respond to RFE in this scenario. Any chances of getting approved? Thank you. Attorney_15 Posted February 3, 2019 Report Share Posted February 3, 2019 If the only reason for stopping work is the expiration of work authorization AND a client letter was submitted, then it is generally permissible to respond to the RFE arguing the sufficiency of the existing evidence. The odds of approval are on the low side but there does sound like there is a legal basis for responding to the request. Link to comment
