VivekK2000
Hello, I'm working in the US H1-B visa. My green application(I-140) is in progress. My spouse is a Post-doc associate in molecular biology at University of Chicago. She is on J1 visa. I wanted to know what's her career path to get a green card? Can she apply for a EB1-A or EB2-NIW category at a later point? Thanks. Link to comment
JoeF
The J1 may have a home residency requirement. She would have to get a waiver before a GC application. Generally, if she gets a tenure-track faculty position, EB1-EA is a breeze. EB2-NIW may also be possible, depending on her research. Link to comment
VivekK2000
Thanks JoeF!. One more question please. Does she stand a chance of getting an employment with a public/private company in the US and then they filing her GC using EB1 or EB2 category? Link to comment
