H1B Transfer Denied

Hi, 

    My H1 was approved with EmployerA in Oct 2017 with a valid I94 till Sep 2020. My employment with EmployerA ended on Jan 31 2018 but they filed reported termination of employment on Feb8 2018 . I found that I had 60 day grace period and EmployerB filed for a transfer on Apr9 2018. I found out that my transfer was denied yesterday(12/22/2018). I got the job with Employer B before the end of grace period, but the application was sent on Apr 9 2018. I want to know what are my options? What are my chances of getting an approval if I file another application or appeal the decision?

When did you start working for B?

Any approval would be with consular notification, without an I-94. You ha e to go abroad, wait for the approval, and then get anew visa and enter with that.

An appeal would be a waste of time and money. USCIS did nothing wrong, your employer filed too late.

Thank you JoeF. I started working after I received the receipt notice for the transfer application. But my transfer is denied. I would like to know if there are any other options?

Hey, May I know reason for Rfe details before denial? It's speciality occupation?

The RFE is regarding the speciality occupation, Employer employee relationship and asking for an explanation about my I-129 being expired on Feb 8 and my petition was filed on Apr 9th.

I just found out that the reason for denying my petition was speciality occupation.
