permand140
Please clarify this My H1 Approval Till Date is different from date in Amendment. H1 approval is till Nov 2019. Amendment is valid till end of Feb 2019 only. I want to apply for H4 EAD for my spouse. Please let me know, if I can apply H4-EAD based on H1 Approval or Amendment Approval Or Should I apply H1 Extn and H4 EAD at the same time (Since Amendment is till Feb 2019 only) Please suggest Link to comment
care_candidate
H4 EAD requires primary beneficiary (H1 holder) to have an approved I-140. Link to comment
permand140
Thanks for the response, Care_Candidate After H4EAD is approved, the validity of the H4 EAD approval date will be based on my H1 Approved Validity date or Amendment Validity date? Link to comment

It would be approved until the latest petition validity date, which is the amendment date in your case. Link to comment
luck2u
@permand140: In your case it is good to file extension for H1B, H4 & EAD together in Premium Processing for the upcoming expiration of your existing H1B (Feb'2019) as there is no location change. Extensions will be filed in Nebraska Service Center where Premium Processing is active. Link to comment
