H1B I797 expires on Dec 31st and extension filed endedup with RFE, can i goto stamping in india now?

Recommended Posts

Hi,

I have to travel to India on personal work and i couldn't get visa appointment earliest and latest available is Dec 20th and i expected my H1B extension would get approved before i goto stamping but it ended-up in RFE.

Now i am confused because i am not sure what will happen if i goto interview now on 20th December with i797 validity of 10 days .

Q) Can i goto stamping in such case?  - what would happen if go?

Q) If they approve my visa till validity , Can i travel ? What will be the consequence at POE.

As my plan was to travel back to US, due to situation in my project.

Thanks in advance for your suggestion,

Regards,

MS

1. Not advised to go when you have a RFE, they reject.

2. They may not approve as your new one is in process and you got to wait for approval.

1. Yes, but what info did you fill in DS-160. Existing I-797 details or RFE I-797 details.

2. Yes. No issues. Just tell them you have a pending application.
