Extension was applied Dec-19-2017 Converted to premium processing before 240 days in Aug -2018, got an RFE and submitted response in Nov Dec-6-2018 got a denial Question is 1. Since when my unlawful presence is counted ? 2. Since when am I out of status ? 3. How many days I have to leave the country ? Link to comment
simply.phani Posted December 9, 2018 Report Share Posted December 9, 2018 Hi 1# From the date your I-94 expirey to denial date / current date is unlawaful stay. 2# when your company recieves hard copy or from the denial date 3# immediately 1-2 weeks if you don’t have valid I-94 as per news from online, if your unlawful stay is more than 180 days, there might be a possibility of barring couple of years to enter into US** ** may not 100% correct, check with your attorney. i am also in same boat. my visa expired in July 2018, petition denied in dec 2018. In process to leave US i am looking for answers if anybody re entered into US after their earlier unlawful stay? Was there any issue while filing petition/visa or POE? Thanks Link to comment
