H1B Transfer based on I-140 approval

Working IN H1B visa for Past for Past 7 years and PERM and I-140 approved two years before (Eb2 priority date is May 2016) from Company A

I have received offer from Company B and  plan to join based on Company A 1-40 approval to Company B. 

My Priority date will  be current might be after 10 Years around 2026 end. 

Please let me know when  do i need Initiate PERM and I-140 again for Company B  .

  • DO i need to start ASAP after joining   the company B after 3 months.
  • or Do i need to initiate PERM and I-140 before Company B H1B  visa expiration.
  • or can i Start perm and I-140 process before I-485 stage around 2025 before my priority date is Current.
  • for ie: if i didnt start PERM and I-140  in Company B based on company A i-140  approval can i  get get H1B extension  for Company C  in future?

As long as I-140 from the previous employer is valid, the new employer can file H1-B petition under "change of employer" and asking for "extension of stay" beyond 7 years. 

1. You can join a new employer within 60 days of USCIS receipt notice date. 

2. You can do that. 

3. You can do that too. 

4. Yes, as long as I-140 is valid; any employer can request an extension of stay beyond allowable 6 years.
