Currently

  • Waiting for my 7th year extension and amendment to be approved
  • Having approved I140
  • Completed 200 days after i94 expiry
  • Employer is not willing to pay salary after 240 days

I would like to know

  • Is it legal to stay in USA after 240 days of i94 expiry?
  • What options do I have to get paid after 240 days of I94 expiry?
  • Can I change my employer before 240 days?

Hi Rajesh, My 6 years in H1B ends on March 2019 and my H1B extension is applied in normal process after the i-140 approval, can I be eligible to stay for a max of 240 days till i get a update on my case? or I need go back to India before my H1B maxout? Please let me know..

Your best option would be to upgrade your H1 to premium processing and get the approval before the 240 days cap.

Even otherwise, you dont have an option because your employer will stop paying and you are out of status once they stop paying.

Even if you change the employer, you will have to go with PP.
