However, due to unfortunate circumstances I came back to india suddenly. I got a new job and they and not willing to tranfer my H1 b. I just want to find out if my H1b is still active or not. I have original approval notice I797A with me. Would you please help me with this? Any help is appreciated Link to comment

ibrahim237 Posted December 2, 2018 Report Share Posted December 2, 2018 Hi Kumar, Is your new employer not willing to transfer your work visa ? Are you still with your current employer ? My understanding is that since you didn’t initiate a visa transfer, your I-797 will still be valid. Also, PP is not open until Feb 2019, for H1-B transfer cases. I am not an attorney. Link to comment

That's the only way you can start working for them. Your old H1 was for a different employer, and it is gone, anyway, since you no longer work there. Seems that this company is a bit clueless about the H1. They should discuss the situation with an immigration lawyer. Link to comment
