mics
Hi, I am currently holding an H-4 visa and working in India. My spouse is in US on H1-B and her H1-B is valid till Nov'2020. My company has filed my L1-A (individual) under premium process. There is an RFE raised on my L1-A application, asking details for my travel to USA, which we will respond as I went for personal trip to meet my family for few weeks. Last week, my spouse PERM is approved and her employer has to file I-140. My query is that, if my spouse go ahead with her I-140 filing (under premium process) while my L1-A is in process. Will it impact my L1-A petition in any way? Also, how long can she wait to file I-140? Appreciate your early feedback. BRs, Nakul Link to comment
pontevecchio
Her I-140 filing has nothing to do with your L1. Link to comment
mics
Thanks pontevecchio. I have one more query, i travelled for few weeks on H4 visa this year to make a personal trip. I have completed 1 year employment with my employer and attorney has filed L1A after adjusting the time for personal trip. Does this personal trip made, impacts the L1A visa process? Link to comment
pontevecchio
No, it does not. Of course your lawyer knows the drill and you should not be second guessing him or your employer in a forum. Good luck. Link to comment
