rahul_34b
Hi,I moved from Company A to Company B on H1-B receipt number. The transfer got denied and 'A' is already revoked my H1-B. Now I am planning to go back to India. If I want to file a new H1-B from India(with company C), whether it should go through lottery process again or I can use the cap exempt quota? Link to comment

CSERFE
No lottery. You can use unused quota from 6 years. Link to comment

The OP was counted in the quota when the H1 from A was approved. That means he is not counted again until the 6 years are over. It is completely irrelevant if the H1 from A was revoked. A was required by law to inform USCIS that the OP no longer works there, but that has no effect at all on his ability to get a new H1 without going through the lottery. Link to comment
