k_qryguy Posted November 20, 2018 Report Share Posted November 20, 2018 Hi I am on my Final extension and 6years duration would complete around Dec 2nd week 2018. I got RFE on my I140 on "Ability to Pay" and although my attorney submitted the my companies 2017 Fed tax returns and additional documents to refer the assets, income etc - USCIS denied I140 stating its not sufficient. My attorney has filed Motion(I290B) explaining the detail of the tax returns, assets, income during 2018 and thus ability to pay. Also, in parallel H1 Extension is filed in Normal Processing (based on the I140 for 3Years) so that by the time H1 Extension RFE comes, with approved I140 via Motion, the RFE would be responded. I have following queries: 1. Is there a chance to get Motion cleared in favor of me? 2. as stated, my H1 6Years span expires on December 2nd week, 2018 - so with latest H1 Extension filed(3 Years based on I140) - can I continue to work post 2nd Week of December? 3. In case motion is denied and I have to leave USA - in that case, could the I140 filed again? Link to comment
Merries Posted December 13, 2018 Report Share Posted December 13, 2018 Any updates? My i-140 was denied too and my case is still in AAO. It got approved last May but AAO hasnt returned yet the case back to USCIS. I wonder who has the same case here? How long did you wait for AAO to return the case back to USCIS so they can issue the Approval Notice? Thank you Link to comment
