ScoobyDoo1
Hello, I have an approved H1-B petition with a consular appointment (I am yet to get my visa stamped in India). I am looking for starting a PhD and transfer to an F1 visa. Would I need to get my H1 visa stamped in order to avail the advantage of using the remaining period of the current approved H1B petition and not having to enter the H1B cap when I apply for jobs after finishing my PhD? Please let me know, Thanks in advance! Link to comment
LeaveMessageH1B
why would you even apply for H1-B in first place ? ? imo in order to avail advantage you should have at-least worked for that employer, take advice from qualified attorney. Link to comment
Chai
Yes you can get H1B stamp however, H1B status and counting in the cap would only start when you draw your first pay check. Entering the US on H1B and transferring to F1 without working would NOT count towards cap. Link to comment
