I'm in my 7th year of H1-B extension and my recently filed extension petition was denied and i'm now back to India as my I 94 was expired. I'm planning to file a new petition with Employer B. Can he file a new petition with my 140 approval from Employer A or Does the Employer B has to file for perm and 140 before he can apply for a new H1-B petition? Thanks in Advance for your responses! NotAnAttorney Posted November 6, 2018 Report Share Posted November 6, 2018 Emp B can file for your H1B without going thru PERM/140 at this point of time. Just make sure your i140 was in valid state atleast for 6 months after approval. Link to comment
