A new employer B filed h1b transfer in premium processing on 30th aug 2018 and on 11th Sep 2018 it went in RFE status. Still working with employer A. There are two questions 1. If new employer is responding to RFE then my case would still be in premium or not as premium processing is suspended? 2.If in any case my h1b transfer is getting denied then would I be able to continue with employer A or I have to leave country ? If I have to leave then how many days I would get to bind up ? Thanks Link to comment
pontevecchio Posted November 4, 2018 Report Share Posted November 4, 2018 For future reference, a "transfer" of a H1 means another H1 petition filing by an interested employer and subsequent approval. NOTHING gets transferred and you can continue to work for any previous employer with an approved H1 petition for you. Link to comment
