Hi there,

 

While on your 7th year of the H1-B, and an approved I-140 towards the green card process, is it possible to change employers?  If so, will your new petition be counted against the cap? Also how many years will one receive on the new H1-B visa? What will happen to the I-140? Will you have to start from scratch with a new employer?

You can change employers in H1 status. Extensions of H1 beyond the initial total of 6 are possible with no extension more than 3 years and also if the I-140 is pending 6 months plus, you can get H1 extensions with any employer till the PD of the I-140 is reached. Obviously a new employer will ultimately have to file your GC from scratch.
