krishgvk
I came to H1B in 2008 and stayed for 15 months through a consulting company. Later moved back to India and came to US again through one of the big MNC in India in Feb 2013.I am not sure, if the big MNC filed my petition as CAP or CAP exempt. I don't have the copy of I 129 for the petition. Will USCIS ever approves H1B beyond 6 years without I-140? My current petition is valid till Feb, 2019. with this can i assume, the MNC company filed the petition under CAP?How to get the copy of I 129 to confirm that it was filed under CAP. Since, I left the MNC, they are not providing the required informationThanks Link to comment
JaiTrump
How did you get your visa stamped without the approved petition? If you came in feb 2013 and your visa is valid till feb 2019, you have used your 6 years of H1, it is obvious that it’s not cap exempt. Are you so lost to realize this? Link to comment
krishgvk
I mentioned, i don't have the copy of I 129 with me. My previous company has it. My question was since now i got the 6 years from Feb 2013 to Feb 2019, means the MNC filed the petition in CAP. Is this assumption correct? Link to comment

Not the total period of approved H1B. Please request approval copy of the i-129 petition through FOIA. USCIS will send you the copy of the approval. Link to comment
