H1B petition transfer with cap exempt

Hi,

     I got H1B visa in the year of 2004. I traveled to US during May 2004 and returned back by Oct 2004.  Now I am again in US from Jan 2017 till now through L1B visa.  I like to know whether can I use my older H1B petition for a transfer with cap exempt and utilize the balance 5 years and 8 months period?

Yes you can. Contact immigration attorney and do it in a proper procedure.

You can utilize your old H1b but not 5 years and 8 months. Your time on L1B visa will be deducted from total of 6 years.
