samsc Posted October 27, 2018 Report Share Posted October 27, 2018 Employment with latest employer "A" ended a few weeks ago, and waiting for H1B petition to be filed by employer "B", expected in a couple of weeks. I-94 on the passport (obtained during last entry to US) expired more than an year ago. The I-94 that came with the approval of H1B filed by "A" is valid for more than an year. Would the continued stay in the US be treated as invalid stay? Does 60 day grace period apply in this case too? Link to comment
