H1B Transfer and 60 day grace period

I got a job offer in August with a 9/17/18 start date so I handed in my resignation and ended previous employment on 9/14. Receipt notice was received 10/3/18 for H1B transfer and RFE sent on 10/10/18. RFE response has not been sent yet. Since receipt notice was 10/3, am I still in status and is 60 day grace period still in effect? Employer does not want me to start on portability because they want to have the approval in hand first.
