GSGDGG Posted October 24, 2018 Report Share Posted October 24, 2018 Hello: I have an Approved I-140 that was filed by a previous employer under EB2 [Mem of profession w/Adv Deg, sec 203(b)(2)]. I-140 has priority date in 2007 (current for India) and was not revoked. I-485 filed was filed concurrently in 2007 but was not followed through (moved back to India) and subsequently denied in 2009 due to abandonment without prejudice to filing another I-485. Now in 2018 I am on L1A (intracompany transferee, executive or manager) with another company and have worked abroad for more than 1 year previously with this company. How do I retain the priority date from my EB2 approved I-140 for my EB1C I-485? Do I need to re-file I-140 with new employer? What is the best and fastest way for GC? Link to comment
pontevecchio Posted October 24, 2018 Report Share Posted October 24, 2018 The best way is for the company to file a concurrent I-140 along with AOS/EAD/AP BASED on EB2. Your lawyer will cross reference your existing approved EB2 and claim your PD of 2007. Link to comment
