As per my current passport I don't have any LAST NAME, but my FIRST NAME is Vivek Mohan. So, in all my H1B/I797/SSN documents my FIRST NAME is FNU and LAST NAME is Vivek Mohan (because USCIS does not allow anyone with blank LastName). I have my I797 approved until Apr 2020 with the mentioned name(FirstName : FNU and LastName : Vivek Mohan). Now, my employer is applying Green Card for me and as a first step during PERM process, I have below options to choose from: 1. Passport amendment option ; split the name as FirstName : Vivek and LastName : Mohan 2. File the PERM with “ – ” symbol for the last name 3. File the PERM with last name listed as LNU for Last Name Unknown or Last Name Unavailable and understand the risk of denial or non-acceptance of the I-140/ I-485 in future by USCIS (even if PERM is approved with LNU). My questions are : 1. If I go with option# 1, I have been told that I should be applying for my H1B amendment to update my name to match with passport. So, is this H1B amendment required ? 2. And if H1B amendment is required to update the name and gets denied, can I work until Apr 2020 with my current approved I797 ? 3. What are the chances of my PERM/I-140/I-485 getting denied if I go with either of the options - 2 & 3 as my FirstName and LastName will be different in H1B/I797/SSN and PERM/I-140 ? Thank you!! I have the exact same situation and during PERM review (Not yet submitted) immigration specialist gave me option to go with 1) Splitting Names in Paasport 2) Going with "-" in LastName and take the risk of denial. 3) Going with LNU in LastName and take the risk of denial. Immigration specialist mentioned that even if my PERM approves, it will have issues during I-140 & I-485 approval. Please suggest. Quote Link to comment
sreedhara.ch@gmail.com Posted October 3, 2019 Report Share Posted October 3, 2019 Hi Team, I have also same problem my labor already submitted so please let me know what needs to be done My passport has Given Name as – Sreedhara Jogappa , Surname Name - blank All my I-797 documents have First Name - No Given Name, Last Name – Sreedhara Jogappa However, labor submitted with following name, First name – Sreedhara Jogappa, Last name - LNU. I want to know will this cause me any problems going forward when I file for H1 extension, I-485/Green Card Quote Link to comment
