OCI card for newborn

Hi All, Need some advise about a situation. My primary & wife's dependent visa & I94 will be expiring by early Jan and extension will be applied prior to it. The second part is that we  expecting a baby by Feb. I heard that OCI card or any type of India visa can not be applied if parents visa is not valid for 3 months. Did anyone had similar situation and what are the options in case need to travel to India? Do they accept extension acknowledgement as extension results might take more time Thanks for all the help.

Apply for an Entry (X) Visa. It is limited for the below types of visitors to the country:

• A foreigner who is of Indian origin.
• The above person’s spouse and kids or Indian citizen.
• The spouse and dependent kids of a foreigner visitor on a long term Visa like Employment visa /Business Visa.
