I recently got my H1B extension petition approved with the validity from 01/19/2019 to 12/27/2021. I am planning to get my Visa stamped in India so that I get my H1B visa until 12/27/2021 in the passport. Could you please let me know if I have to carry both the I797A documents when I am attending the visa stamping as my latest I797 A is valid only from 01/19/2019. Link to comment

I also wanted to ask about the existing H1B visa stamp that i have in my passport which is valid until 18th Jan 2019. What will happen to this visa stamp when i get the new stamping done using the petition that i valid until from 19th jan 2019 to dec 2021. Would the existing visa stamp be overwritten with the latest visa stamp?. The reason i am asking this question is my latest petition is valid only from 19th Jan 2019. Hence i wanted to get clarification on this before i go for visa stamping. Request you to clarify. Link to comment
02112018 Posted October 8, 2018 Report Share Posted October 8, 2018 According to immigration system, your latest stamping will be valid per the approval dates from 19th jan 2019 to dec 2021. You would still have the existing stamping valid until 01/18/2019. If you return u.s after 01.18 they validate the latest h1 approval. Link to comment

For issuing the I-94 at the port of entry in USA, which petition would be considered. Please clarify. I would not want to end up in a situation where i may not be able to travel to US until 19th Jan 2019 which is the start date of my latest petition. Link to comment

But keep the OLD 797 with you in case officer would like to see it or have any questions in issuing new i-94 while you entering u.s Link to comment
