INGCQ Posted September 26, 2018 Report Share Posted September 26, 2018 I have my priority date of June 2017 with approved I-140 in EB3. My company sent me back to India in January 2018 as they did not file for the extension. One of my colleague said that if i do not get paid in USA for more than 6 months, then i have to redo my PERM and I-140 again when i come to USA in order to retain my priority date. Is this true or my I-140 will be valid irrespective of my presence in USA and will not affect my GC process Regards, Venkat Link to comment
