AOSapplicantFeb2020 Posted September 24, 2018 Report Share Posted September 24, 2018 Hi, I would appreciate your advise on my situation below: I have an approved LC and I-140 with Company A (Priority date: May 2009) in EB3 India (According to Oct Bulletin "Dates for Filing chart" - EB3 India is 1st Oct 2009) I quit Company A and joined Company B in Apr 2017 (Company B has not filed either LC or I-140 so far) What is the best way to file my EAD/I-485 concurrently, considering I am with Employer B at this time? care_candidate Posted September 25, 2018 Report Share Posted September 25, 2018 Assuming it is unlikely for you to go back to employer A, you will have to start process from scratch with employer B. As you know it will take a year and half to complete LC & I-140, but after that your chances of getting PD to surpass your PD are higher & you can apply for EAD with I-485 together. If your new employer hasn't filed for LC, why did you leave employer B at this stage almost 10 year after you were in line? How did you get H1-b or H1b extension for new employer? Link to comment
