Hi,

I have been in US for  6 years and would be returning to my home country next month. I want to know that what would be the best time to apply for L1A in order to get a full 7 year term?

Will going to the home country and applying for L1A after few months only get me 7th year of stay as an extension of my H1B mps? Can I apply for L1 and make sure to travel to US for time on L1A once my 1 year of H1 clock reset happens.

Please advise.

Thank you!

First, you can only apply for an L1 if you have been working for the employer abroad for at least a year in the last 3 years.

Second, the clock only resets if the person is abroad for  year before a new petition is FILED.

That makes very clear that you can only apply for an L1 after a year abroad.
