Venkiram10 Posted September 23, 2018 Report Share Posted September 23, 2018 Hi Murthy, My employer had filed H1B amendment for new work location and I have received receipt, as part of new location my salary is been revised however my HR has mentioned that new salary will get inforce only after my amendment is approved, until then my previous location salary will only be paid. I have travelled from Tier 3 location to Tier 1 location as a result this has impacted my cost of living badly, however I was told as per process only the new pay structure will be paid only if H1B amendment is approved. Like to know is that true? please note:- LCA for my new location is filed and approved, which was presented for my H1B amendment petition filing. Link to comment

However, as a thumb rule, If you have started working at the new location then the LCA terms for the new location should be in effect and by not paying you the LCA amount, your employer is in violation of h1b laws. Wouldn't hurt to consult a qualified labour and or immigration attorney in your area. Link to comment
