cyberlord
I was in the United States on H1-B from 2013 - 2015 (2 years). I then traveled back to my home country due to personal reasons. I am currently employed in my home country. My employer is asking me to travel to USA on L1-B (with per diem salary paid in my home country, accommodation and others borne by the company), and has started paper works for filing my L1-B petition. Questions 1. Will my H1-B petition get cancelled if my L1-B petition gets approved? I have 4 years remaining on my H1-B. 2. Will I be able to change employers once I'm in the USA on L1-B, if I can get another employer who can file a cap-exempt H1-B for me? Link to comment
pontevecchio
1. No. H1 time will be reduced by every day in L1 status. 2. Yes, subject to the total of H1 plus L1 beibg 6 years. Link to comment
