Sre Posted September 11, 2018 Report Share Posted September 11, 2018 My H1 extension petition got denied recently and I have my current H1 valid until Dec31, 2018. Please suggest. 1. Can I stay and work until Dec 31st with the current employer ! I heard that notice of denial specifies a date or period to leave the US, would it be earlier than I- 94 expiry date! 2. What are my other options, if I find another employer or different position from same employer, is the grace period applicable in that case if another transfer petition is pending ! Link to comment
NotAnAttorney Posted September 11, 2018 Report Share Posted September 11, 2018 1. You can stay until DEc 31. 2.Either your employer can refile, or a new employer can file and if filed within time, you can stay upto 240 days after i94 expiry. Link to comment
