hello84 Posted September 11, 2018 Report Share Posted September 11, 2018 I have an approved I-140 from Employer A. Employer A was able to get a three year extension based on the approved I-140. I found employment with Employer B, that was able to transfer the visa and get a three year extension based on the Employer A's approved I-140. The H1B VISA for Employer B is valid through September 2021. My questions follow: If employer A withdraws I-140 then,Will Employer B be able to get another visa extension post September 2021 based on the approved I-140 from Employer A? It seems that Employer B may not be willing to initiate the GC process until 2019. My concern is that I could risk running out of time on the H1B VISA that Employer B has through 2021. pontevecchio Posted September 11, 2018 Report Share Posted September 11, 2018 If your I-140 was valid for more than 180 days, you are allowed further H1 extensions beyond the initial 6 until your PD is current. This applies irrespective of what A does. I would suggest keeping abreast of current developments by occasionally reading the Murthy website for relevant news. Link to comment
