I also got picked in H1B lottery this year but issued RFE and still the case is in pending. So while applying for OPT-Extension, do I need to mention about the H1B application anywhere? In I-765, there is a question for "Have you previously applied for any Employment Authorization". Do we need to mention about pending H1B there or we need to just mention about previous OPT approval? "Have you previously applied......" this question is related to YOU which means your previous OPT and CPT approvals. H1B is NOT something that you will apply..It is employer who applies for your H1B. So, you dont 'have to mention about H1B in your OPT-extension application. Although, they would know that there is a pending H1 petition for you. Link to comment
