I94 extension after passport renewal

Hello,

This is for H4 spouse visa,

I-797 expires: 06/05/2020

Visa expires: 06/05/2020

Passport expires: 02/26/2019

I94 expires : 02/26/2019

Once we get the new passport, what is the procedure to get the I94 date extended? Is it necessary to get it extended since the Visa is valid till 06/05/2020 which is the I797 expiration date? Please guide me on this.

My attorney advised to file new h4 extension and he is doing it. Let me know if you find different options.

Either file a H4 extension or get a letter from your lawyer about the matter and go to the Tijuana border with Mexico and make an Uturn and ask CBP to give you a new I94 based on the approved H1 petition of your spouse. AVR is not a compulsory imposition and can be declined if the needs arise. The fee for a new I94 is 12 USD.

When I confirmed with my attorney they said H4 extensions are taking long time already the cases are pending since 18 months..if you have any updates pls let us know
