I got an F2 visa to stay with my husband after my marriage in jan 2018. I came to India in August 2018 and applied for F1 visa and was rejected twice with 214(b) slip. Only my Passport and I-20 was viewed during both the interview. During the first interview the VO asked about my husband employment in the US, and when I said he was on F-1 she asked if it was F-1 OPT and denied my visa. During the second interview the VO pointed out that I have an active F2 visa and I already have a master s degree in India. After which she denied the Visa. My husband is starting his H1B from October and I am planning to apply for H4 along with my husband. I am worried if my recent F1 denial will affect my H4 . In case my H4 is denied can I travel to US in my b1/b2 visa and apply for COS. Thank you for your patience . Quote Link to comment
Provence Posted August 29, 2018 Report Share Posted August 29, 2018 The CO had their doubts; why on earth go to school with a master under your belt? As long as there was no misrepresentation (lie) during the F1, the denials should not affect the H4. And no, you cannot enter on a b1/b2 with intent to COS. satya2k1 Posted September 11, 2018 Report Share Posted September 11, 2018 I don't see any issues with H4 visa stamping as long as your husband's work authorization and employment are genuine. If you accompany your husband when going for his H1 visa stamping then chances are high of getting your H4 visa. Good luck. Quote Link to comment
