chaddibanyan Posted August 24, 2018 Report Share Posted August 24, 2018 I switched jobs recently and the attorney of the new company did not file H4 extension, claiming that the previous H4 is approved until 2020. Now, my wife's visa stamp and I-94 are expiring in Oct-2018. She also wishes to travel to India in Jan-2019. The attorney claims that she can carry the H4 approval I797 from previous employer and my H1 approval from current employer and obtain a visa stamp. Is this really a true scenario? Anyone has had similar experiences? Link to comment
satya2k1 Posted August 29, 2018 Report Share Posted August 29, 2018 Does her previous H4 approval came with a new I-94 until 2020? If yes, then she is file. She is in valid status. When she travel to India, she needs to carry your H1 approval copy to get visa stamp at the consulate to enter the USA. Link to comment
