BJV
My background: I applied for PERM (GC) in EB2 category during Oct 2011 through Employer A. Labor and I140 was approved. I was forced to move back to my country because of personal reasons and later resigned from employer A. Later I140 was revoked by Employer A in Sept 2013 after I resigned. I'm currently with another employer (Employer B) and now in US with new H1 Visa.Question: 1. Can I apply for new GC/PERM using the previous priority date (filed in 2011)? 2. Does the revocation mean its been cancelled forever or is there a way that I can reactivate the I-140? 3. I know the receipt number for I140 but don't have any records or receipt number for Labor application approval. How can I get that? 4. Is my wife eligible for EAD application using the previous I-140 or If I apply for a new GC using previous perm date? please assist. thanks, BJv Link to comment
pontevecchio
1. Yes. Stop saying I when you mean the employer. 2 That I-140 is gone. That PD is retained in the absence of fraud. 3. ? 4. NO. Link to comment
jvivekan
You can get your I-140 by raising FOIA request. You need to send them the receipt notice. I got mine through that route Link to comment
care_candidate
3. Just talk to your old employer. They must have kept record of your documents. Link to comment
