adityatandel Posted August 11, 2018 Report Share Posted August 11, 2018 i am currently on a h4 visa expiring on 9/8 and my I-94 expires on 9/18. my spouse's h1b petition has been filed and is being processed. can her employer file for a h4 extension for me while her h1b petition is in progress? can i stay in the US while the h4 petition is in progress? in the light of the recent USCIS notice (link attached below) the government is being very strict on people staying beyond their I-94 expiry date. should we both (or just me) leave the US while our petitions are being processed? https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2018/2018-06-28-PM-602-0050.1-Guidance-for-Referral-of-Cases-and-Issuance-of-NTA.pdf Link to comment
